France revamps rape law after Gisele Pelicot case

France Revamps Rape Law

France has updated its rape law to include the concept of consent, following the high-profile Gisele Pelicot case.

The new legislation states that consent must be freely given and can be withdrawn, and cannot be assumed from silence or lack of resistance.

French criminal law previously defined rape as a penetrative act or oral sex act committed on someone using “violence, coercion, threat or surprise”.

The changes bring France's legislation more into line with over a dozen other European countries.

The update was prompted by the Gisele Pelicot mass rape trial, in which her husband admitted to drugging and recruiting men to rape her while she was unconscious.
